Terms and Conditions for Hananoeau Community Art Upload

Welcome to Hananoeau, a cooperative project hosted at www.hananoeau.com to raise funds for women’s healthcare, including in areas where access to pregnancy termination may be restricted. By participating in this initiative and uploading your artwork (“Content”), you agree to the following terms and conditions:

1. Voluntary Participation

Uploading Content to Hananoeau is entirely voluntary. By submitting your artwork, you affirm that you are doing so willingly and without coercion.

2. Non-Exclusive License

By uploading Content, you grant Hananoeau, its authorized collaborators, and any individuals, organizations, or entities they deem appropriate to participate in this cooperative project, a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, display, distribute, and sell your artwork. This license includes:

  • Creation of derivative works in any media or format, now known or later developed.
  • Modification or adaptation of Content for formatting, promotional purposes, or display needs.

All proceeds from the use or sale of your artwork will be directed to women’s healthcare initiatives, including advocacy and support for abortion rights in restricted areas. Hananoeau commits to transparency in fund allocation.

You retain full ownership of your artwork and may continue to use or license it for any other purpose outside this project.

3. Representations and Warranties

By submitting Content, you represent and warrant that:

  • You are at least 18 years old or have obtained parental/guardian consent if you are a minor.
  • You are the sole owner or have the necessary rights to grant the license described in these terms.
  • Your Content does not infringe upon any copyright, trademark, or other intellectual property rights.
  • Your Content does not violate any laws or promote hate speech, discrimination, or violence.

4. Attribution

Hananoeau and its collaborators may credit you as the creator of the Content where appropriate. However, you agree that attribution is not guaranteed in all uses.

5. Revocation of License

Due to the nature of this fundraising initiative, the license granted is irrevocable for any Content already used or incorporated into materials. If you wish to remove your Content from future use, you may contact Hananoeau at [insert contact email]. Removal requests will not affect existing inventory, campaigns, or materials that already include your Content.

6. Financial Transparency

Hananoeau commits to general transparency regarding the allocation of proceeds from the use or sale of your artwork. Information on fund allocation will be made available on the website or upon request.

7. Privacy Policy

By submitting Content, you may be required to provide personal information (e.g., name, email). Hananoeau will use this information solely for project-related purposes and in accordance with its Privacy Policy, which can be found at https://www.hananoeau.com/privacy-policy/

8. No Guarantee of Commercial Success

Hananoeau makes no guarantee that your Content will result in sales, promotion, or specific use in campaigns. All decisions regarding the use of Content will be at Hananoeau’s discretion.

9. Compliance with Local Laws

You are responsible for ensuring that the submission of your Content complies with the laws of your jurisdiction. Hananoeau is not liable for any legal issues arising from non-compliance.

10. Indemnity

You agree to indemnify and hold Hananoeau, its collaborators, and affiliates harmless from any claims, damages, or legal fees arising from the use of your Content or your breach of these terms.

11. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Hawaiʻi. Any disputes shall be resolved under the jurisdiction of courts located in Hawaiʻi.

By uploading your artwork, you affirm that you have read, understood, and agreed to these terms and conditions.
